Most important IP developments in India over the past 12 months will be presented. A patentability criterion of a pharmaceutical case may be discussed based on a court decision . Patent linkage in India may also be explained with reference to a court decision . IP protection and public interest are now deliberated in India. For example, as border measures, Intellectual Property Rights (Imported Goods) Enforcement Rules, 2007 may be utilized since mere representation by the patent holder is sufficient. There is no obligation to give notice to importer. It may be explained that efforts have been made to improve enforcement of IP legislation in India by way of example: Bajaj Auto Limited V/s. TVS Motor Company Limited . As one of special practices in India, a patentee has to file a statement regarding the working of the patented invention on commercial scale in India. Now, it may be discussed what is considered as working, and what will be a penalty and other consequences if failing to file the statement. Delibation may be made with reference to the US patent system.
