Should You Appeal?

--- Success Rates Before PTAB on Individual Rejection Basis ----      


A patent application filed in the United States (8) is examined by an Examiner at the USPTO (9). If allowed, a patent is granted (12), but if not, it may be rejected (10) such that the Applicant must choose an appeal (red box), an RCE, or a give-up. If the rejection is overcome, it will be allowed (12) such that a patent will be issued.

This seminar covers statistic results of appeals after the final rejections.

Those statistic data will give us some kind of insight on whether an appeal should be filed. Please refer to Mr. Pool's paper. Mr. Pool's paper has been gaining some attention in the United States such that Mr. Pool has been asked to speak at the USPTO to present the paper to some Examiners and Board members of the Patent Trial and Appeal Board (PTAB). Mr. Pool is conducting additional research such that he will be sharing the latest information with the attendees at the seminar.
In particular, Mr. Pool may explain new guidelines issued on January 4, 2019. Here, we have old guidelines in chart and revised guidelines (in use) as exemplified by chart . His personal comments may be available in the seminar and the Q and A section as well as the simple reception after the seminar.
The seminar will be given in English. And Mr. Aikawa will be a moderator and a translator.
