Avoidable Pitfalls in Claim Drafting of European Patent Applications --- Based on Recent Decisions of Examining Division of The EPO ---- The presentation may be composed of two parts. Part 1 will relate to the communications according to rule 161/ 162 EPC, rule 62a(1), reply to search report, objection of a lack of unity in the search report. G09-0001 may be referred to. Part 2 will relate to important decisions like G2/08 (swisstype claim), T 1511/07 (combination of two especially preferred ranges), T 1374/07 (selection of two components from one list), T 1467/ 08 (amended claims supported by the teaching of a figure), T 1068/07 (disclaiming an example), and C-428/08 (Monsanto, scope of protection for claims containing biotech inventions) .
