How to obtain quick and effective patent protection in Europe

--- Quick, Inexpensive, and Strong Patent Right ----      

In order to obtain the patent protection in some countries in the Europe, many Japanese applicants utilize the EP application under the EPC. However, it may be time to consider a strategy to make an EP patent portfolio of their own. Here, the some tips and know-how will be shown in the lecture.

1) Introduction of the German Patent/Utility System
Comparison with the EP system may be illustrated. Some characteristic features of German patent/utility system may be focused. In particular, the patent folio should be made in consideration of the German patent/utility infringement lawsuit. The German Utility Model may be referred to Sharp Sword, but this is often unknown to foreign clients.

2) Patent Prosecution Highway (PPH) - Japan / Germany, Japan / UK, Japan / EPO
Brief summary of PPH for above mentioned countries will be made to explain what is necessary for using PPH. The prosecution timeline of the PPH may be illustrated such that the attendees may realize how long it will usually take before the first office action, how soon the applicant should respond thereto, and how the applicant can obtain the extension of due date. There may be differences in requirements for patentability in the EP prosecution if the equivalent Japanese application is allowed.

3) Differences in patent examination - Quality and Speed in Germany and before the EPO
Who are more generous to the applicant, German examiner or EPO examiner? Do they use the common database? How soon will the granted application (German or EP application) be registered in the German Patent Office?

4) Inventive Step before the German PTO and the EPO
What are "Problem-and-solution approach", "Could-would approach" and "reading between the lines"?, and effective response against them. Examples and a little Exercise will be provided.

Profile
Dr. Robert Fichter is a German patent attorney, European Patent, Trademark and Design Attorney as well as a Director of the law firm Dennemeyer & Associates. He is also CTO at Dennemeyer S.A.. Before these positions in the Dennemeyer Group, Dr. Fichter was a partner of a Munich patent law firm. At TJ Group GmbH in Munich, he headed the unit for Intellectual Property software, and was responsible for the development of IP Management and IP Monitoring Software, as well as for IP Consulting. Between 1996 and 2001, he was employed at 3M ESPE AG as a patent and license specialist. There, he developed concepts and applications for document, IP, innovation management, and patent monitoring. He implemented these as part of R& D-wide projects in the company.
