Partial priority of a European patent application

--- A brand-new decision of the Enlarged Board of Appeal (EBA) ----      

 
Claiming priority from an older patent application is a standard tool for patent for a patent practitioner. What happens if the later patent application has a broader scope (for example: metal) than the priority application has a narrower scope (for example: aluminum)? EBA was asked in a case where a claim of a European patent application encompasses alternative subject matter by virtue of one or more generic term may entitle to partial priority of one specific term. More specifically, it is referred by the case T 557/13 with respect to European patent application Nos. 98203458.9 and 95923299.2 claiming the priority from GB 9411614.2.
