CAFC Decision on USPTO Rule Making --- Understand Decision and Now What --- The US Federal Circuit issued a decision on Tafas and SmithKline Beecham Corp. v. Doll on March 20, 2009, regarding new rules by the USPTO. The CAFC upholds the USPTO's rulemaking authority in some of them, but limiting the number of continuations is inconsistent with the mandate in 35 U.S.C. §120. The case was remanded for further proceedings. According to the USPTO, the Final Rules are not implemented at this time. In the seminar, the decision will be explained and better understanding could be obtained through the question-and-answer session.
