Patent Litigation Strategies in Europe --- litigation forums, EPO oppositions and appeals, national courts ---- There are many different Courts in Europe and it can be difficult to understand how patent enforcement proceeds in Europe. We will discuss tactics, timelines, costs, predictability (of procedure and of outcome), the level of damages and the risk of a finding of invalidity, and how the UPC (Unified Patent Court) might change strategies, amongst other topics. In particular, the following topics may be addressed. a. Introduction of the different litigation forums in Europe and their general characteristics. b. Detail about European Patent Office (EPO) oppositions and appeals. c. The characteristics of the main European national courts which deal with patent invalidity and infringement actions (Germany, UK, France and the Netherlands) and discussion of their different characteristics and from which national courts a litigant can choose and the factors which will influence the choice.
